Terms of Service

These terms are an agreement between the business that signs up (“you”) and raidandev (“we”, “us”) for use of the Portal staff scheduling application. By starting a trial or paying for a plan you accept them on behalf of your business.

1. The service

Portal is a hosted web application for scheduling, time clock, time off, shift swaps and team communication. The features and limits of each plan (employees, managers, locations) are listed on the pricing page and are enforced by the application. To go over a limit, upgrade or add a location.

Features marked beta or “in development” are offered as-is, may change or be withdrawn, and are not covered by the rest of these terms' promises about the service.

2. Free trial and automatic renewal

Plans start with a free trial (the length is shown at checkout). A card is collected at checkout but not charged during the trial. Unless you cancel before the trial ends, your subscription starts automatically and your card is charged the price shown at checkout.

Subscriptions are billed in advance, monthly or annually as you chose, and renew automatically at the end of each period until cancelled. Additional locations on the Pro plan are billed per location on the same interval. Prices are in US dollars and do not include any sales tax that may apply.

3. Founders' rate

If your checkout showed the founders' rate, your discount applies for as long as that subscription stays active. It does not carry over to a new subscription after cancellation. In return we may ask to show your logo, quote a testimonial and hold an occasional feedback call; you can decline any of these without losing the discount.

4. Price changes

We may change our prices. An existing subscription keeps its price until we give you at least 30 days' notice by email, and a change never applies to a period you have already paid for.

5. Cancelling

Email us from the address on the account and we will cancel the subscription so it does not renew. Your service continues to the end of the period you have already paid for. Refunds are covered by our Refund Policy.

6. Late or failed payment

If a payment fails, we will email you and retry. If it is still unpaid after 14 days we may suspend access until it is paid. Suspension does not delete your data; section 8 describes when deletion happens.

7. Your accounts and your staff

You are responsible for the staff accounts you create, for keeping login details secure, and for telling us promptly if you believe an account has been compromised.

You decide what staff information goes into Portal and are responsible for having the right to hold it. If you turn on the GPS time clock, you are responsible for telling your staff and getting any consent your local law requires. Portal is a record-keeping tool, not legal or payroll advice: you remain responsible for your own compliance with wage, hour and employment laws, and for checking time records before you pay from them.

8. Your data

The data you put into Portal belongs to you. We use it only to provide the service, as described in our Privacy Policy. You can ask for an export of your business's data at any time while you are a customer, or within 30 days after your subscription ends, and we will provide it in a standard format.

After your subscription ends we keep your data for 30 days in case you change your mind, then delete it from the live service. Copies in our backups are overwritten as those backups expire, within 12 months.

9. Acceptable use

Do not use the service to break the law, to store content you have no right to hold, to harass anyone, to probe or attack the service or other customers' data, or to resell access without our agreement. We may suspend an account that does, and will tell you why.

10. Availability and support

We aim to keep Portal available and to announce planned maintenance in advance where practical, but we do not promise uninterrupted or error-free service. Support is by email; we aim to reply within one business day.

11. Warranties and liability

Except as stated in these terms, the service is provided “as is” without warranties of any kind, to the extent the law allows. Neither of us is liable to the other for indirect or consequential losses, such as lost profits or lost business. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

12. Changes to these terms

We may update these terms. We will email you at least 30 days before a material change takes effect. If you do not agree, you may cancel before then and we will refund any unused prepaid time.

13. Governing law

These terms are governed by the laws of the State of Nevada, USA.
